I live in Flordia, Escambia county. My son was born in Mobile County, AL but has lived in Escambia county since we left the hospital. His father was currently incarcriated at the time of his birth so he was never listed on the birth certificate. Now my son is 3 and will be starting school and he has his fathers last name but is not involved at all and I want my son to have my last name because I am the primary care taker. We live in different state as well. He would obvisouly never agree to sign concent but because he is not a legal father, with no name on his birth certificate can I get a waiver?
